The federal appeals court has upheld a ban on deploying national guard in Portland, Oregon, after a latest legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on this week that it would rehear the legal dispute concerning the executive power with an larger panel of eleven justices. The court also overturned a previous decision from a smaller judicial group that had sided with the administration.

Legal Saga Over Military Presence

This order represents the latest turn in a protracted legal battle over whether the administration has the authority and justification to send state military units in the city. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was started in response to ongoing demonstrations.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that municipal police have command of the situation.

Contrary to characterizations of the city as a conflict zone, locals have been sharing footage of scenic paths and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a US district judge in Portland issued two legal injunctions this month – one blocking the federalization of the state troops, and another stopping the deployment of any military personnel in Oregon, after efforts to circumvent the first order by calling up out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the forces.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with both rulings under review simultaneously – by a panel of 11 judges.

“This decision demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The constitution restricts the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the military into American urban areas without cause. We will continue protecting Oregon’s laws, principles, and sovereignty as this case moves forward and our fight continues in the courts.”
